The estate agent Krishan Kumar Shetty had filed a case against Aishwarya Rai, her father Krishnaraj Rai, mother Vrinda and brother Aditya for non-payment of the brokerage amount in the Metropolitan Court, Bandra in suburban Mumbai last month.
The Additional Chief Metropolitan Magistrate SY Sisode had issued summons against the Rai family to appear in the court, returnable on February 27, but Rai moved the Session Court seeking a stay on the summons.
The Additional Session Judge HS Deshpande admitting the matter on February 25 had issued notice to the respondent, directing them to appear in the court on March 9 for final hearing.
Shetty advocate Ramesh Singh said that Rai and her family had approached Shetty in 1998 to purchase a flat in Bandra. They had subsequently booked under-construction flats in 'La Mer' through Shetty. He alleged that despite having taking up residence in the Rs 2 crore flat in 2001, they had failed to pay the brokerage amount.
